The Faculty of Law of Wijaya Putra University (FH UWP) in collaboration with the Development Study Club (DSC) held a book review entitled "Presidential Dismissal in Indonesia: Between Theory and Practice", on Thursday, December 19, 2024 through the Zoom Meeting virtual room.
The resource person for the activity was a Constitutional Law Expert from the University of 17 August 1945 Surabaya, Dr. Hufron, S.H., M.H., who is the author of the book and invited a Legal Practitioner from Wijaya Putra University, Dr. Nuryanto A. Daim, S.H., M.H. as the respondent.
The book review was attended by dozens of participants consisting of FH UWP students, as well as academics and legal practitioners in Surabaya. The discussion was guided directly by the Head of the UWP Master of Law Study Program, Dr. Suwarno Abadi, S.H., M.Si.
In his presentation, Dr. Hufron conveyed an overview of the substance of the book he published in 2017. In the book, he conveyed a number of recommendations.
"One of my recommendations is for the Constitutional Court to decide whether the president is dismissed or not, which is why the Constitutional Court should play a role at the end, not in the middle as in the current Indonesian constitutional system," Hufron explained.
He saw that the design of the presidential dismissal in Indonesia did not yet reflect a presidential system. Because the MPR will later determine whether the President is dismissed or not. According to him, this shows the characteristics of a parliamentary system.
Meanwhile, Dr. Nuryanto A. Daim, who was a respondent at the book review, saw the dismissal of the president from the perspective of a state of law and democracy. According to him, what needs to be studied is whether the proposal to dismiss the president is truly the will of the people according to the principles of democracy or merely the will of the political elite.
"Therefore, the principle of a state of law must always be juxtaposed with the principle of democracy, and cannot stand alone. So that the dismissal of the president is truly the will of the people, not just the will of politicians like the case that occurred during the time of President Gus Dur (Abdurrahman Wahid-ed)," he said.
Dean of the UWP Faculty of Law, Dr. Andy Usmina Wijaya, S.H., M.H., met in a separate place said that this book review activity is an implementation of the Cooperation Agreement agreed upon by FH UWP with the Development Study Club in early December.
"We would like to thank the Development Study Club for facilitating today's book review activity," said Andy.
He also hopes that with the book review activity, the level of student literacy will increase so that they can make legal opinions at a practical level in the future.
"This is in line with our vision at the Faculty of Law as a school of litigators based on Legalpreneur in line with UWP's vision as an Entrepreneurial University based on Sociopreneur," he said.
