Raising the Issue of Sea Fences, BEM Faculty of Law, Wijaya Putra University Holds Legal Study

The Student Executive Board of the Faculty of Law, Wijaya Putra University (BEM FH UWP) held a seminar on Legal Studies Volume II with the title "Sea Fences from the Side of Land Ownership Rights (HGB)", the event which was attended by dozens of academics from FH UWP and a number of activists was held at the UWP Faculty of Law Building, Benowo Campus on Tuesday, February 25, 2025.

The resource person at the seminar was Dr. Khusnul Yaqin, S.H., S.pN., M.Hum., who is a Notary and Lecturer at FH UWP and moderated by Arya Dwi Setya Permadi, who is a student and member of BEM FH UWP. The Chief Executive, Imam Alamuddin said that the theme chosen for this legal study was a hot legal issue in society. "It is hoped that the issue chosen will increase knowledge and insight for students in the field of Agrarian Law related to issues in the field." Imam said.

In the presentation session, the resource person explained that to answer the issue of sea fences that have recently been popular in society, there are a number of questions that must be answered. "The first is whether a certificate for the sea is possible?, second is whether the area is a reclaimed area?, third is whether the area is an emerging land?, and finally is whether the area was previously agricultural land such as a pond or fishery." Khusnul explained. He emphasized that in essence, a sea certificate is illegal referring to the Constitutional Court Decision Number 3/PUU-VIII/2010 which states that the sea cannot be owned by individuals or legal entities.

Moreover, in the case of the sea fence that is currently viral, it cannot be classified as reclaimed land or emerging land if you look at the case's position and legal facts. Meanwhile, if the land is a pond, it should be classified as land that has been destroyed due to abrasion and has resulted in the termination of land rights. "If there is a sea certificate, then it is illegal and null and void, so the cancellation of the certificate must be submitted through the PTUN." He explained.

Dean of FH UWP, Dr. Andy Usmina Wijaya, S.H., M.H., appreciated the implementation of legal studies that raise current issues in society. He hopes that in the future legal studies that raise the hottest legal issues in society will continue. "The implementation of the Legal Study is in line with the concept of FH UWP as a School of Litigators and the vision of FH UWP, namely Legalpreneur based on research," he said.
